Shared Ownership Code

Am I covered if I need to make a complaint?

If your developer is on the Register of Developers and you reserved your home after their registration date, then you are covered by the New Homes Quality Code and can ask the New Homes Ombudsman (NHOS) to investigate your complaint.

NHOS website

The complaints process

First contact your developer about your issue to see if you can get it sorted before requiring escalation.

Check that your developer is on the Register of Developers & that you reserved your home after the registration date.

If no – You are not covered by the code, but you should contact your developer in case you are protected by an alternative scheme.

If yes – You are covered and can ask the New Homes Ombudsman (NHOS) to investigate your complaint.

See if your developer is registered

Find out whether the developer you reserved your new home from is registered with the Code by using the search below.

If you already know your developer is registered

  1. If you wish to make a complaint to the Ombudsman, you can visit their website. They will ask you to enter details of your complaint and provide any supporting evidence. If your complaint is eligible, the Ombudsman will approach the developer to give their side of things.
  2. Both parties have the opportunity to review all the information and evidence that has been provided before the Ombudsman makes an assessment on whether there has been a breach of the New Homes Quality Code.
  3. The Ombudsman will publish a draft decision and both parties have 10 days to add any further information before the final decision is published.
  4. Any additional comments are reviewed by the Ombudsman before they publish their final decision to both parties.
